ORDINANCE NO. 773
AN ORDINANCE AMENDING PROVISIONS OF CHAPTER 92 OF THE CODE OF ORDINANCES OF THE CITY OF SERGEANT BLUFF, IOWA PERTAINING TO WATER RATES FOR SERVICE & BULK WATER SALES
WHEREAS, the City of Sergeant Bluff, Iowa provides water service for the customers of the City and shall establish fair and equitable distribution of charges for water service among its customers; and
WHEREAS, the City Council of the City of Sergeant Bluff, Iowa, has determined that users of the water system should pay for its operation and maintenance by payment of service fees, which must be adjusted from time to time to reflect cost increases;
WHEREAS, the City Council of the City of Sergeant Bluff, Iowa, determined that the Basic Service Charge and Usage Charges should increase;
NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF SERGEANT BLUFF, IOWA:
SECTION 1.SUBSECTION MODIFIED. Chapter 92, Section 92.02 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following adopted in lieu thereof:
92.02 RATES FOR SERVICE.
Water service shall be furnished at the following monthly rates within the City effective with the first bill due in August 2026:
1.Basic Service Charge. A minimum basic service charge of $18.87 per month; except for Multi-Family Residential Facilities of greater than twenty-four (24) living units and that are billed by master metering, which shall have a minimum basic service charge of $3.95 per living unit per month.
2.Usage Charge. An additional usage charge of $6.29 for each 1,000 gallons of water, or portion thereof, used in any month.
SECTION 2.SUBSECTION MODIFIED. Chapter 92, Section 92.03 of the Code of Ordinances of the City of Sergeant Bluff, Iowa is repealed and the following adopted in lieu thereof:
92.03 BULK WATER PURCHASE.
1. Hydrant Metered Water. Hydrant metered water shall be furnished at the rate of $15.00 for each 1,000 gallons of water, or portion thereof for commercial businesses only. Additionally, the user will be charged a $100.00 meter installation fee. Residential swimming pools shall not be filled using hydrant metered water.
2. Bulk Water from Overhead Feed at Water Treatment Plant and Public Works Building. Bulk water from overhead feed at the Water Treatment Plant or the Public Works Building for filling purchaser's large container shall be furnished at the rate of $11.00 for each 1,000 gallons of water, or portion thereof.
SECTION 3. SEVERABILITY. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 4. EFFECTIVE DATE. This ordinance shall be in effect from and after its final passage, approval, and publication as provided by law.
