4. CITIZEN'S INPUT:
Katie Aman, 802 Glenwood, and son Lincoln attended to express a concern. The park at the Rec Center has had broken equipment, the play structure and bridge is closed off. She stated it is not safe or effective. She also mentioned other equipment that is broken. She asked if there is a plan to get it fixed?
Kirk Moriarty stated that the Parks & Recreation Board recently voted to seek bids to get the equipment replaced.
There was discussion about the safety of the existing structure, the elements of the park that are still functioning, the measures taken to restrict the unsafe area, the availability of other parks in the area, and the source of funds for replacing the equipment.
Jason Kvidera will have his crew look at taking the bridge part down to enhance the safety.

7. RESOLUTION(S):
7.aRES 24-23 Setting Date for Public Hearing on Urban Renewal Plan Amendment for the 1st Street Corridor Urban Renewal Area
Jason Kvidera described the upcoming steps including having a meeting with the school and county prior to the public hearing. The public hearing date would be October 22nd.
Motion by Mark Reinders, seconded by Andrea Johnson to Approve RES 24-23 Setting Date for Public Hearing on Urban Renewal Plan Amendment for the 1st Street Corridor Urban Renewal Area.
Motion Carried. [Unanimous]
8. ORDINANCE(S):
8.aORD 755 Amend the Zoning Map of the City of Sergeant Bluff (Rezone Property AR to BG) Second Reading
Ron Hanson said that there is a party interested in building a facility that is medical related in phase 2.
Mike Robinette with HRW Holdings said that phase 1 will be two 6,000 sq ft buildings. Andrea Johnson asked if the screening would continue for phase 2?
Sarah Kleber explained that screening is controlled by zoning code.
Mike explained that the type of businesses they're looking at serve as a nice buffer to residential areas.
Ron relayed a note from Aaron Lincoln, City Administrator, that expressed that the applicant is requesting that the third reading be waived, the purchasing developer is willing to place covenants on the grounds so that a gas station is prohibited on phase 2. If the reading is waived then the ground could close on September 30th, if not then then land purchased will be delayed until mid-October and the construction process for phase 1 will be delayed.
Ron and Andrea were not in favor of waiving a reading. Mike was fine with waiting.
There was additional discussion about the different type of screening that could be used to buffer the areas.
Mark Reinders asked how close the back of the building(s) would be to the nearest home in phase 1.
Mike thought approximately 70 feet.
Andrea said that we received a follow-up letter from Doug & Sally Vickery who submitted a letter at the last Council meeting. They wanted to know if hotels would be allowed?
Sarah reviewed the code and stated that it is listed as a Conditional Use in the BG zoning district which would require additional approvals.
Mike said that he does not have an interest in building a hotel there and would be willing to restrict that.
Harold Drotzmann, 2206 Hwy 75, asked if the buffering would go all the way along the south side of 220th Street (for noise control).
Mike said that the access would come from Hwy 75 rather than 220th.
Mark asked if they stipulate that a gas station can't be built, does that stipulate that future developers can't build one?
Sarah said that would require a deed restriction. A convent applies for a 20 year period. It wouldn't necessarily be indefinite.
Motion by Moriarty, seconded by Ron Hanson to Approve ORD 755 Amend the Zoning Map of the City of Sergeant Bluff (Rezone Property AR to BG) Second Reading.
Motion Carried. [Unanimous]
9. ADMINISTRATOR'S REPORT:
Jason Kvidera, Assistant City Administrator, provided an update on the Trail and 1st Street. We walked the trail with the construction company last week, there were no issues other one driveway that will need some concrete replaced. For 1st Street the contractor will pour the north half on Friday and hopefully come back Monday to do the south side. They should be done with the main route by late next week.
10. COUNCIL MEMBER'S REPORTS & COMMENTS:
Kirk Moriarty said that the Community Center has holes in the roof that is causing mold, it's a priority to fix that before winter gets here. He said that the sidewalks and street that have a lip that inhibit wheelchairs on E Street, City staff will look at that. The new playground equipment at B Street has been installed, it looks nice and it already getting used.
Carol Clark reminded residents that this is the last week for garbage collection from Gill Hauling. Leave your cart out for removal. Carrier Container Company will start next week. She thanked Ron, Mark and other volunteers for participating in the 24on24 litter pickup.
Andrea Johnson thanked Aggies for providing lunch for those participating in the 24on24 litter pickup. Last week Aaron, Mark, and herself attended Iowa League of Cities event, there were some interesting seminars. She reminded businesses in town to get their business in the Explore Siouxland directory. The Rec Center is having many events in October, she encouraged residents to check those out. On October 6th please go to the Fire Station for the open house, there will be food and a bouncy house.
Mark Reinders said that the new playground equipment at B Street looks wonderful. He said the 24on24 litter pickup was very well attended, there were many students from the National Honor Society who participated. He thanked Aggies for providing a delicious meal. He found the seminars at the Iowa League of Cities to be very informative.
Ron Hanson provided a map to the Council Members of the safe-routes-to-school map created by SIMPCO. Warrior Road is not completed at the intersection yet, but it will be soon. He discussed ADA requirements that may need to be discussed during budget season. He was glad to be able to participate in the 24on24 litter pickup.
